[ << | >> | ^^ ] Subject: Bad behavior and the law From: Peter Doherty <leasttern(AT)HOTMAIL.COM> Date: 1 Feb 2003 1:28am Much has been written abt the mousey NJ photographer, also the male operator of an older Dodge mini van bearing NJ plate GIW 35X. Here is the present law and administrative position of the responsible agencies as I understand them: (a) The Northern Hawk Owl is, indeed, a bird protected under the Migratory Bird Treaty Act of 1918 [MBTA]. http://migratorybirds.fws.gov/intrnltr/mbta/mbtandx.html [see taxonomic family strigidae]. Thus, the statement by the NYDEC spokesman reported in the Schenectady Daily Gazette of 1/28/03 concerning the bird's non-migratory status is incorrect. Section 703 of the MBTA provides, in part, that "it shall be unlawful at any time, by any means or in any manner, to pursue.....any migratory bird....included in the terms of the conventions...." The NEast FWS regional office [region 5] does not view the use of mice to photograph to constitute "pursuit" under section 703. Therefore, while protected, from hunting, killing and other "take" under the MBTA, the Hawk Owl on its winter quarters in the Town of Root is, at present, not protected under federal law from such activities as were witnessed there on Thursday, January 30. Nor do other federal statutes or regulations protect the owl from such actions according to FWS Region 5. (b) At present, the administrative position of NYSDEC on the legality of actions such as those of the NJ photographer is unclear. I have made several inquiries and will report their results to you as I receive responses. I have not researched NY law on this point. In the interim, it is up to those interested in the welfare of the owl and those who adhere to or concur with the ABA Code of Conduct/Ethics to persuade/shame/intimidate/coerce those who might not understand or might not have considered the consequences of their actions NOT to feed or otherwise interfere with the diurnal activities or energy budget of the owl in Root. The owl is an able predator. Today, January 31, 2003, the bird made 6 unassisted, confirmed kills of wild rodents. The bird cached at least two kills made on this date. Other kills have been previously cached and at least one clearly observable kill has yet to be consumed. I believe the other cached prey have not been consumed by the owl [or any kleptoparisite]. One of its favorite perches is the maple = tree in the front yard of the farmhouse. This bird is very easy to see = from the road, so there is no need to trespass onto the farm property to = get a "better view." Professor Ben Burtt has set up his NewsLine phone = number as an update for sightings of the Hawk Owl. Call the NewsLine = number at 472-2111 (or check pg 2 of the Syracuse Post Standard for a = local number in your area). Once the greeting begins, press 7336 to = hear Professor Burt's update, which will be changed by 8 AM daily. As = always, birders are encouraged to call the Birdbox at 315-637-0318 to = leave a report of their sighting. This is one of those instances where = the Birdbox can be invaluable to people coming from far away to receive = up-to-the-minute reports on the Hawk Owl's status when planning their = trip. Directions from the Syracuse area: Take US Rt 20 east to the = town of Carlisle, Schoharie County (roughly 100 miles from where Rt 20 = intersects with I-81). In Carlisle, head north on Rt 7A for about 1.6 = miles. After crossing the Montgomery County line, the road name changes = to Corbin Hill Rd. Near the 3/10 mile marker along the road, there is a = white farmhouse with a red barn and 2 white silos. This is where the = Owl can be located. To our north, a SNOWY OWL was found along Rt 11 north of Watertown in = the town of Philadelphia. It has been seen near a barn on the east side = of Rt 11 about 2.1 miles south of the Indian River High School. This = location is just north of Townline Rd, bordering the towns of Leray and = Philadelphia. There is an unnamed road lined with light poles and = surrounded by fields that heads east from Rt 11 near the barn where the = Owl has been seen. The last report of the Cayuga Lake GYRFALCON was on Tuesday, January 28, = when the bird was spotted feeding on something in a field along Lake Rd = just south of the village of Aurora. From Rt 90 heading south out of = Aurora, turn right onto Lake Rd and follow to the top of the hill. This = is the vicinity the bird was seen feeding. Back at home, things have not been nearly as exciting. A large mixed = flock of 310 HORNED LARKS and 118 SNOW BUNTINGS was found last Saturday = along Rickard Rd, north of Coon Hill Rd in Skaneateles. Also on = Saturday, over 2000 COMMON MERGANSERS were at the south end of Onondaga = Lake, with lots of MALLARDS, BLACK DUCKS, and a few GADWALL, SCAUP and = BUFFLEHEAD. Later that evening, a GREAT HORNED OWL was spotted emerging = from a roost tree in Onondaga Park on the city's south side. =20 The Oswego Harbor is jammed with ice, and the ice shelf reaches out into = Lake Ontario for about a mile or so. There is a little open water in = the Oswego River near Coleman's Pub, and the remaining waterfowl up = until at least Tuesday included LONG-TAILED DUCKS, COMMON GOLDENEYE, = BUFFLEHEADS, and COMMON and RED-BREASTED MERGANSERS. Further up the = Oswego River, near Phoenix, a female WHITE-WINGED SCOTER that was found = above the dam last Saturday was still present today, while 3 more = WHITE-WINGED SCOTERS, a COMMON LOON, and 6 HOODED MERGANSERS were among = the hundreds of waterfowl below the dam and north of the bridge today. A few other local sightings include a BARRED OWL perched mid-day in a = tree along Rt 28 in Newport on Wednesday, a COMMON RAVEN flying by the = end of Nine Mile Pt Rd in Scriba on Thursday, and 7 ROUGH-LEGGED HAWKS = (4 dark morphs) in the Daysville Rd area of Mexico also on Thursday. = Close to a dozen PURPLE FINCHES continue to visit a feeder south of = Fulton, while a female plumaged PURPLE FINCH and 3 WHITE-THROATED = SPARROWS can still be found at a feeder in Camillus . =20 On Sunday, February 2, Bill Purcell will lead a field trip to the Oswego = River and Harbor to look for wintering waterfowl and gulls. [ << | >> | ^^ ] Subject: The Crow Shoot in Auburn From: Carolyn Keefe <CARJK209(AT)AOL.COM> Date: 1 Feb 2003 2:30pm Hello Birders, The Syracuse Post Standard had a good length article about the crow shoot in Auburn this weekend on the front page today, concluding on the back page of the first section. Now the organizers of the shoot (who have partially good hearts, in my opinion) have finally found a charity that will accept some money from the $15 per person registration fee charged to each shooter. Many charities have turned down this money, and not quietly, either! The group that will accept the money is the Syracuse Food Bank. They don't have weekend hours, just a huge telephone menu leading to a few answering machines. It's a given that this is a good charity that has done much good. But the other good charities wouldn't accept this , well, tainted, dirty money. Some of the charities made statements to that effect in the Post Standard. No other food banks would take this Crow slaughter money. So I called them and left several messages explaining my position etc. Syracuse Food Bank 6970 Schuyler Road E. Syracuse, NY 13057 Attn. At about 2:pm today, I noticed a large mixed flock foraging in the creek behind my house. Hoping for a new yard bird or two, I scanned and found about 30 AMERICAN ROBINS along with about 20 Starlings. Soon, a new Bird emerged from the creek, and went for the ground feeder...a RUSTY BLACKBIRD!! F. Lacy Rd and Towne Rd (towns of Richland/Albion) - 2 dark RLs and 2 E. Bluebirds (equally amazing considering the snow). CR 41 south of Atkinson Rd in town of Richland - 5 light RLs seen while parked at one spot. Atkinson Rd - 1 light RL and 2 Bluebirds Salisbury Rd - 4 Bluebirds NY Route 3, Daysville Rd & Sherman Rd area - 6 light and 7 dark RLs on various roads. That's 21 Roughies in about nine miles concentrated near CR 28 and I found none in side trips both north and south of there. Other birds were 8 Turkeys at Albion Cross Rd and 68 more on a manure spread along CR 28, 6 Red-tails and 1 Kestrel. Several manure spreads had no larks or buntings. At least 8 SHORT-EARED OWLS were present at Tadmor Farm, where South Avon Rd. crosses Nations Rd. The birds were seen from the end of South Avon where the gate is, perched on fence posts and hay bales. At the corner of Fowlerville Rd. and Boyd (one road east of Nations), the corn-cut north of Fowlerville Rd. had many cobs of corn visible on the ground and at least a couple dozen LAPLAND LONGSPURS. Also present were a few SNOW BUNTINGS and HORNED LARKS. Horned Larks were found at a number of other locations as well. Also, NORTHERN MOCKINGBIRDS, RING-NECKED PHEASANT, and the usual raptors. Viewing here is excellent because you are very close to the birds, no more than 50 yards and in many instances much closer. Even as I left more gulls were coming in and I see Joe Brin found even more a bit later. Phoenix - 1 Glacous Gull, 1 White-winged Scoter and 1 Belted Kingfisher - none of which were seen in the morning. Fulton - 1 adult Bald Eagle, 2 Pied-billed Grebes Oswego - 2 White-winged Scoters between the dams, harbor frozen but Long-tailed Ducks & G. Scaup in River and an adult Peregrine standing on the ice in the harbor. East of Derby Hill, towns of Richland and Mexico - 6 Rough-legged Hawks, 2 Am. Kestrels and 1 Northern Shrike plus 70 Cedar Waxwings just south of the village of Mexico. We came across a couple of mixed flocks of Buntings as well as fantastic views of 24-30 Lapland Longspurs in a cornfield on the North side of the road just West of the Boyd Rd.and East of Nations Rd at aprox.12:30 pm. For those of you not familiar with Nations Rd ,it's a must trip for Short-Eared Owls, Mosy recently seen at the Intersection of Nations & Hogmire Rds hunting the fields and perching on haybales and fence posts of the Tadmore Farm. This strip on River Rd. between Chandler and where the road turns to dirt is loaded with brush and brambles and plenty of birds. I tried for it between 1:30 and 2:30 with no luck. There are many manured fields with surrounding trees along that stretch, so the bird can be anywhere. The location is: Page 76, D1 in the DeLorme atlas. East of Chittenango, Madison County. (This is the same place that one was seen in 1992.) Chittenango is located on Route 5. Continue east from Chittenango. I did not measure the distance this afternoon, but the road starts level, then goes up a steep hill. After you go over this hill, you will see a blue Harvestore silo on your right, the south side of the road. This is opposite Harsh Road. This morning the bird was seen one mile east of the blue silo, also on the south side of the road. It was opposite Del Mar Motel, sitting in a deciduous tree. Needless to say, please report this bird if you locate it. Route 5 is a busy highway, but today there was a good wide shoulder that we drove on. Please be careful. Dorothy W. One was sitting on the ice way down the river. We saw it by = parking at Dunkin Doughnuts, walking to the river, and scoping to our = left (east?). There were three Pied-billed Grebes and a mixed flock of = Redhead/Ring-necked Ducks in that area as well. The second Iceland (a = much paler individual than the first) was flying around near the bridge. = I couldn't find anything interesting at Mercer Park, have to try again = later for the LBBG. After spending a few hours in Baldwinsville we headed up to Phoenix. = There was a beautiful (2nd winter?) GLAUCOUS GULL standing and swimming = near the stones under the falls. We were able to get some nice photos. = After scanning the gulls for a while longer an immature ICELAND GULL = turned up here as well. Other birds in Phoenix this afternoon included = the three WHITE-WINGED SCOTERS, Great Blue Heron, Belted Kingfisher and = all three Mergansers. I'm wondering what is the "official" status of the Mute Swan in = Baldwinsville? Is it countable? I assume it can fly but it also = doesn't ever seem to go anywhere. Right now I've counted it (I'm up to = 56 for the region so far this year) but I can never remember what I'm = supposed to do about birds like Mute Swans. Any help? They 'post' their property, but use the parking lot during the day only on Saturdays and Sundays. The man who observed this bird will ask the other club members at their meeting this week to allow birders to park in the lot, but not roam the property (the owl was observed in the tree closest to the clubhouse- very near the road). I never new they ate suet. I clearly saw the bird peck at the = suet and eat it. I've had a decent variety of birds this year with more American = Goldfinches than I've had in the past. In fact, goldfinches are the = most numerous birds. I've had few House Sparrows and occasionally get = House Finches. For living on the border of the city, that's amazing. I = usually have about 80 of those birds, sometimes 150. I only = occasionally see those birds now, if you can believe that. I think = feeding the birds later in the year helps keep the numbers down on = "House" birds but keep the thistle feed going so as to keep the feeding = station active with goldfinches. Letting the feeders run out = occasionally also discourages the "House" birds. I haven't seen the = White-throated sparrows that I had for the month of January these past = few days. I had a flock of about 30 American Robins yesterday. Patrick Sullivan reported it from Gee Road on Sunday. We searched that area also. To reach that location, drive 1.7 miles north of Route 5 on Harsh Road. Turn left on Gee Road. Drive west on Gee Road and you will come to the Chittenango Rod and Gun Club. It was seen on the edge of their parking lot on Sunday. We continued north on Gee Road as far as the Thruway with no luck. On Monday it was found on Route 5 east of Chittenango in Madison County. DeLorme page 76, D-1. Coming from the west, Route 5 goes through the village. At a traffic light, Route 5 makes a right turn and heads due east. From that traffic light, drive 2.5 miles where there is a blue Harvestore Silo on the right and Harsh Road goes north on the left. On Monday it was seen one mile to the east on Route 5 opposite the Del Mar Motel. In strong NW winds, occasional snow squalls, infrequent sun and falling temperatures, just before noon the bird was located by birders fm Poughkeepsie on a perch 1/3 miles north of the home perch in the ash and poplar surrounding the two residences on the east side of Corbin Hill Road. It was still present at 1:30 p.m. It was seen deftly to take on the wing a small rodent [likely microtus] just before 1p.m. Prey was taken by the owl to a second perch in the same general area where the prey was partly consumed. It was perched close to the road in a tree line separating two fields (2nd tree line heading back towards Harsh Rd. from the Club). Soon after I stopped the truck, it took off and flew low and fast to the back of the field and then abruptly up and into the trees where I lost track of it in the quickly encroaching twilight. As this is a life bird for me, and I live in Canastota, I will be visiting the area often in hopes of another view. I will keep the list posted on any further sightings. I spent about an hour between = 5 and 6 PM waiting, searching and hoping to see it, but the Owl was = nowhere to be found. Sue Murphy was already there when I arrived, but = she had not seen it either. This bird seems much less reliable than any other Hawk Owl I have ever = heard about or seen. I understand that several people were present this = morning looking for it, but were also unsuccessful. There is an awful = lot of similar looking habitat in this area, and it may just be a matter = of finding the one spot that the Owl considers its "home base". Since the weather was just perfect, I decided to give up my search at noon and drive to another 1.5 hours east to the Town of Root. I was pleased to find the NORTHERN HAWK-OWL in the Town of Root perched in the field across from the residence. We had about 2 hours of solid viewing time. In that space, the HAWK-OWL was VERY active. He flew to 4 different perches, then disappeared for about 30 minutes. The HAWK-OWL then returned, and perched atop the favored tree in the front yard of the residence. I captured about 170 decent shots by Digiscoping the Owl. You can see 6 of my best on my webpage. With bright sunlight, and a close distance between the Owl and the Birders, I had STELLAR results!! One shot I hope to blow up and frame. Ethics wise, things were great. No one acted the least bit unethical. I had the pleasure to meet Peter Doherty, and enjoyed his observations. A few locals stopped by, some with cameras and some with bins. It seems the Owl is making them take notice. A local farmer came up with some snapshots, and asked if I might identify them. The pics were of a Short-eared Owl he had at his farm back in December. These shots were superb!! 20 minutes later, the same farmer came back with a camera and tripod, and got killer shots of the HAWK-OWL as it perched atop its favored tree. Another convert?? Many people have been looking. If you really need it for a life bird, you are probably better off looking for the reliable one further east. The Chittenango Rod and Gun Club is also dificult to find. It is a small building with a very small sign. The directions are to go 2.5 miles east from the easternmost traffic light in Chittenango (where the road takes a sharp turn to the east.) This will bring you to the blue silo and Harsh Road. Harsh Road only goes north from Route 5. Take it 1.7 miles to Gee Road. Gee Road turns left from Harsh Road, but is still going north. Follow it 2.4 miles to the Chittenango Rod and Gun Club. The bird has been seen in that vicinity twice and at the Route 5 site only once. As the owl flies, it looks like the two sites are about a mile and a half apart. The following paragraph was sent to me by a member of their Board of Directors: The club said they didn't mind the (birders') cars parking in the parking lot, as long as they didn't wander around the club property looking for the bird.......they also mention that they don't want the parking lot being used on Saturdays & Sundays for a couple months because of the blackpowder league. They prefer they stay with their cars because we are having some trespass problems. So, at least you can choose to park off the road should you decide to devote what looks to be quite a bit of time waiting for the Hawk Owl to return. On another front, I observed a Rough-Legged Hawk again yesterday; I believe it to be the same one I watched on 2 previous occasions (before I became aware of this listgroup). This bird was perched in a tree across from Caughdenoy Creek Golf Course, on County Route 33. That's 1.3 miles north of the Caughdenoy 4 corners (DeLorme p.75, B-5-- Town Line Rd. BEWARE: Old DeLorme's misidentify Fuller Rd as Rt. 33!). Perhaps it is the same bird seen in Phoenix recently? Only about 6 miles as the owl flies Patrick J. Went looking for Snowy Owl T/Fenner and Chittenango Hawk Owl. We did not find the Snowy or Hawk Owl. Drove the Peterboro Rd, Bellinger Rd area in Town of Fenner by the Windmills and the Gee; Harsh; Tag and New Boston and Rte 5 and no luck on Hawk Owl. Find one very Dark phase Rough-legged Hawk, only white was under wing panels. Saw many Red-tailed Hawks. Today 2-7-03 checked Town of Fenner, no Owl, but a very nice looking Coyote, who had no intentions of posing for a slowing vehicle. I am sure he was thinking Road Hunter when I aim the Camera at him/her. Also a nice Turkey in a tree next to Peterboro Rd. Also checked Gee Rd for Northern Hawk Owl with no luck. (Note: Snowy seen 2-4-03 T/Fenner perched on the old oil/water tank North Side of Peterboro behind the quonset hut.) One was a dark morph that was a really nice looking bird. Looked totally black except for the yellow cere and narrow white bands on the tail. In flight, the white underwing was apparent. Also in this same area, there were two Red-tailed Hawks standing on a nest. They were either adding or rearranging sticks, and one was having a very hard time getting one stick in particular to go where it wanted it. I also had a nice visit with a Sheriff's Deputy while I was scoping the Red-tails. I explained what I was doing and he explained he just wanted to be sure I didn't need help. He had actually passed me, turned around and came back, turned around again and pulled up behind me. He said he didn't notice my hazard lights, but just wanted to be sure I was OK. I thanked him for that. He also stated he checked on a couple of other people who were parked on the side of the road, but they were on the phone. He said it was nice to know some people are following the law. LOL! This makes a total of 2.4 from Route 5, which is where I made the mistake. Sorry. More careful next time. PLEASE follow instructions. The Rod and Gun Club has been very nice about letting birders park off the road in their parking lot DURING THE WEEK. The only other = sighting occurred on Wednesday evening, near dusk, when it was seen = flying from its perch near the Gun Club building, presumably to its = overnight roost. This bird has been very unreliable as HAWK OWLS go, so = any reports of or attempts at seeing this bird would be greatly = appreciated. Meanwhile, the HAWK OWL in the town of Root, Montgomery = County, continues along Corbin Hill Rd. There are also reports from local residents of 2 SNOWY OWLS seen = occasionally in the Peterboro/Larkin/Bellinger Rds area of the town of = Fenner, which is just a few miles south of where the Hawk Owl is = reported to be. There have been no recent confirmations of any = sightings, but birders in the area should be on the lookout for all 3 of = these northern visitors. Several white-winged gulls have been reported from some of the hotspots = along the Seneca and Oswego Rivers. In Baldwinsville, 2 GLAUCOUS GULLS, = 2 ICELAND GULLS and a LESSER BLACK-BACKED GULL were easily viewed from = Mercer Park on the north side of the river on Sunday, with the = white-wingers being reported several more times during the week. = Another location to scan the river is downstream from the dam, near the = Town of Lysander offices just off Lock St, which runs south from Rt 31 = just east of the Dunkin Donuts. Twenty REDHEAD, 3 PIED-BILLED GREBES, 2 = RING-NECKED DUCKS and a HOODED MERGANSER were among the waterfowl on the = river on Monday. Along the Oswego River in Phoenix, a GLAUCOUS GULL and an ICELAND GULL = were highlights of the OAS field trip on Sunday, as were a GREAT BLUE = HERON and a BELTED KINGFISHER. One of the WHITE-WINGED SCOTERS was = still present also. Further down the river in Fulton were 2 PIED-BILLED = GREBES; and in Oswego, 2 WHITE-WINGED SCOTERS were between the dams = while the LONG-TAILED DUCKS continue near Coleman's Pub. There were a = few BALD EAGLE sightings along the river this week between Fulton and = Phoenix, and an adult PEREGRINE FALCON was seen standing out on the ice = in the Oswego Harbor on Sunday. In central Oswego County, an amazing number of 21 ROUGH-LEGGED HAWKS (9 = dark, 12 light) were found in an area centered around CR 28 in the = Richland/Albion area last weekend. Several EASTERN BLUEBIRDS and a few = AMERICAN KESTRELS were also noted. A NORTHERN SHRIKE continues in the = Sherman/Daysville Rd area, while 70 CEDAR WAXWINGS were found just south = of Mexico Sunday. Last weekend's milder weather brought out a few half-hardies, including = the GRAY CATBIRD found along the Erie Canal in Fayetteville and a RUSTY = BLACKBIRD that was spotted at a feeder in Camillus on Saturday. A = feeder in Bernhards Bay on the north side of Oneida Lake hosted a = CAROLINA WREN on Sunday. This is an unusual location for this bird, = which is uncommon in Oswego County. Other reports of CAROLINA WRENS = this week come from more traditional locations in the city of Syracuse = and near Baldwinsville. Other miscellaneous sightings include a NORTHERN SHRIKE attacking a = Downy Woodpecker at a feeder in Cato on Thursday, 4 ROUGH-LEGGED HAWKS = (1 dark) along Rt 31 in Verona on Friday, and another dark ROUGH-LEGGED = HAWK along Biddlecum Rd in Schroeppel on Tuesday. It was not seen again as night fell. The bird made two false swoops, one including a hover, during the last hour of daylight without a kill. The wind in Root was still until late this afternoon. At dusk the wind was out of the WNW and piping up to 15-20 knots; this morning's snow was beginning to blow and drift in the vicinity of the home perch. Those planning to visit Root on Saturday/Sunday should keep an eye on the wind forecast and the Oneidabirds line. The Nat'l weather Service calls for winds here to diminish overnight and shift to the SW at 10-20; likely a good owl day. (It's possible that the broken "gate" on the river in Baldwinsville may be influencing these gulls? Reportedly the water level above the dam is low because of this. There seem to be a lot of gulls with fish. I don't know of the connections among these factors.) Two other places to look are near Cooper's Marina west of Baldwinsville on Rte. 370, and far down the Oswego R. at the bend, in Phoenix, where all the gulls were the other day. Good luck! That Hawk Owl is a most contrary critter because it surely isn't following the typical pattern of being faithful to one area which the bird in Montgomery County is doing. I checked roads north and south of Route 5 as well as Gee Road north of the the Thruway. Lots of potential habitat with lots of Red-tails (2 obvious pairs) and 1 Kestrel. Spent a little time in Fenner looking for the Snowies, it was rather surreal at first with the clouds so low that the windmill blades were hidden. The snow banks on some of the roads, especially Bellinger, make it nearly impossible to see anything. I have already seen this species before, but loved seeing it again. I took my two daughters with me, ages 3 1/2 and 5. This was the first owl they have seen in the wild - not a bad way to start! I did try to get some digiscoped pictures of the owl, but it was not the most cooperative. It stayed in the trees in the field opposite the farm house. We waited for nearly three hours for it to move, but eventually the little ones grew too restless of waiting (while watching videos in the car). I encourage anyone who hasn't seen this species to take the drive out there. It is very easy to see, and there were many people stopping by - birders, photographers, and people in the community who were curious. I want to publicly thank Peter Doherty for giving us daily updates on this bird. I did not see any white-winged gulls at either = Baldwinsville or Phoenix, in the open water north of Fulton there was a = 1st yr Iceland Gull. When I got to Oswego the wind was clearing the = harbor of ice and while I was looking through hundreds of = Scaup,Bufflehead & Long-tails,in the background thousands of gulls were = taking off from the drifting ice, I estimated between 10,000 & 15,000. = the sky literally turned white when they were all in the air, many flew = off as the rest came back to the ice, when I was able to scope through = them I managed to locate 3 1st yr Glaucous Gulls but nothing else of = interest.
